Terms of Service

The terms you agree to when you use neworleanspropertyservices.com, its property search, and its AI Home Concierge.

1. Agreement to these terms

This website is operated by New Orleans Property Services, LLC, a licensed Louisiana real estate brokerage (“NOPS,” “we,” “us,” or “our”). By using the site you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the site.

You must be at least 18 years old to submit a form, create a property-search account, or otherwise transact with us through this site.

2. No agency relationship is created by using this site

Browsing the site, saving a search, or sending an inquiry does not make us your agent and does not create a brokerage or fiduciary relationship. In Louisiana, an agency relationship is established only by a written agreement signed by you and by the brokerage. Until that agreement exists, information you send us is not treated as confidential client information, and we owe you the duties a licensee owes to an unrepresented party rather than to a client.

3. Listing data, IDX, and MLS terms

Listing information on this site is provided through an Internet Data Exchange (IDX) feed from the Greater Southern Real Estate Information Network (GSREIN/NOMAR) and is displayed under that MLS’s rules. By using the property search you agree that:

  • The data is provided exclusively for consumers’ personal, non-commercial use and may not be used for any purpose other than to identify prospective properties you may be interested in purchasing.
  • Listing information is deemed reliable but is not guaranteed accurate by the MLS, the listing broker, or NOPS. Properties may be subject to prior sale, price change, or withdrawal without notice, and a property shown as available may already be under contract.
  • Square footage, lot size, year built, room counts, zoning, permits, school assignments, flood zone, elevation, and insurance figures come from third parties and are frequently wrong or out of date. Verify anything that matters to your decision independently.
  • Properties listed by brokerages other than NOPS are displayed courtesy of the participating MLS members who listed them.
  • You will not scrape, spider, harvest, republish, resell, or bulk-download listing data, photographs, or any other content from this site, and you will not use automated tools to access it.

4. The AI Home Concierge

The AI Home Concierge is a convenience feature that reads your description of the home you want and turns it into a property search. Please understand:

  • It is powered by an AI model. It can be wrong. It does not confirm that any property exists, is available, or is priced as described, and nothing it says is an offer, a listing, or a promise.
  • Its replies are general information, not legal, tax, financial, insurance, appraisal, or engineering advice, and not a substitute for speaking with Kari.
  • Do not enter sensitive personal or financial information. Your description is sent to our AI provider for processing — see the Privacy Policy.
  • Consistent with the Fair Housing Act and the Louisiana Open Housing Act, the concierge will not steer you toward or away from areas on the basis of race, color, religion, sex, familial status, national origin, disability, or any other protected characteristic, and it will decline to answer questions framed that way. Ask about objective property criteria instead, and consult public sources for demographic, school, or crime information.
  • Use of the concierge is rate-limited, and we may suspend or withdraw the feature at any time.

5. No professional advice

Everything on this site — including the Journal, neighborhood pages, market statistics, and home-valuation tools — is general information about the New Orleans market. It is not an appraisal, not a guarantee of value or of a sale price, and not legal, tax, insurance, structural, or environmental advice. Retain your own attorney, accountant, inspector, surveyor, or insurance professional before making a decision.

6. Fair Housing and accessibility

NOPS is an Equal Housing Opportunity brokerage and complies with the federal Fair Housing Act and the Louisiana Open Housing Act. We do not discriminate in the sale, rental, or financing of housing on the basis of any protected characteristic.

7. Acceptable use

You agree not to:

  • Use the site for any unlawful purpose, or in violation of MLS rules or real estate licensing law.
  • Submit false, misleading, or someone else’s information through our forms, or use them to send spam or solicitations.
  • Scrape, crawl, mirror, or bulk-copy the site or its listing content.
  • Probe, scan, or attempt to breach the site’s security, overload it, or interfere with its operation.
  • Copy, reverse engineer, or attempt to extract the prompts, models, or software behind the AI Home Concierge, or use it to build a competing product.
  • Upload anything containing malicious code.

We may block, rate-limit, or suspend access for anyone who does these things.

8. Intellectual property

The site’s design, text, logos, and the “New Orleans Property Services” name are owned by NOPS or used under license, and are protected by copyright and trademark law. Listing content and listing photographs belong to the MLS, the listing brokers, or their photographers. Some New Orleans architectural photography on this site is used under Creative Commons licenses — see Photo Credits for attributions.

You may view the site and print or save pages for your own personal, non-commercial use. Any other reproduction, distribution, or public display requires our written permission.

9. Copyright complaints

If you believe material on this site infringes your copyright, send a written notice to the address in Section 15 that identifies the work, identifies the material and its location on the site, gives your contact information, and includes a statement made in good faith and under penalty of perjury that you are authorized to act for the copyright owner. We will investigate and remove infringing material.

10. Third-party links and services

The site links to and embeds services we do not control — the Buying Buddy® property search, Instagram, Zillow reviews, mapping services, and other websites. We are not responsible for their content, availability, or privacy practices, and a link is not an endorsement. Your use of those services is governed by their own terms.

11. Communications and electronic records

When you submit a form, you consent to receive email, phone calls, and text messages from us about your inquiry at the contact information you provided, including through automated means. Message and data rates may apply; reply STOP to opt out of texts, or use the unsubscribe link in any email. You also agree that notices, disclosures, and agreements delivered electronically satisfy any requirement that they be in writing.

12. Disclaimer of warranties

The site and everything on it are provided “as is” and “as available,” without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title, non-infringement, or that the site will be uninterrupted, secure, error-free, or that its content is accurate or current.

13. Limitation of liability

To the fullest extent allowed by law, NOPS and its members, agents, and employees are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits or lost opportunities, arising out of your use of this site or your reliance on its content — including inaccurate listing data, AI concierge output, or the unavailability of the site. Our total liability for any claim relating to the site is limited to $100.

Nothing in these terms limits any duty or liability that a licensed Louisiana real estate broker owes to a client under a signed brokerage agreement, or any liability that cannot be limited by law.

14. Indemnification

You agree to indemnify and hold NOPS harmless from any claim, loss, or expense (including reasonable attorney’s fees) arising from your misuse of the site, your violation of these terms or of MLS rules, or your infringement of anyone’s rights.

15. Changes, governing law, and contact

We may change the site or these terms at any time; the revised version takes effect when posted here, and continuing to use the site means you accept it. If any provision is held unenforceable, the rest stays in force. These terms are governed by the laws of the State of Louisiana without regard to conflict-of-law rules, and any dispute will be brought in the state or federal courts located in Orleans Parish, Louisiana.
